The Supreme Court of Georgia on Monday rejected the request of Former President Donald Trump to prevent the attorney general from impeaching him for his actions in the run up to the 2020 election.
The Georgia Supreme Court agreed to kill a request that Trump’s lawyers filed a lawsuit last week asking the court to intervene. Trump’s legal team said Fulton County District Attorney Fani Willis and her office were barred from prosecution and that special jury report which is part of the research should be discarded.
Willis has been investigating since early 2021 whether Trump and his allies broke the law when they tried to overturn the election in Georgia to Democrat Joe Biden. He has suggested He is expected to appear in the Supreme Court next month.
The state Supreme Court noted in its five-page decision Monday that Trump also has a similar petition pending in Fulton County Superior Court. The justices unanimously rejected the lower court’s dismissal, writing that Trump “does not demonstrate that he has been denied access to the commonwealth.”
As for Trump’s attempt to block prosecutors, the justices said the filing lacked “the facts or law necessary to disqualify Mr. Willis from this Court at this time.”
A spokesman for Willis declined to comment. Trump’s attorney Drew Findling did not immediately respond to phone and text messages seeking comment.
Trump’s legal team previously acknowledged that the two filters were unusual, but said they were necessary given a tight deadline. Two new senior judges spent last weekand someone can listen to the case.
Trump’s attorneys made the same request in a which was posted earlier in March in Fulton County Superior Court. asked Superior Court Judge Robert McBurney, who is presiding special special judges, to step aside and let another judge hear the Trump team’s arguments. McBurney retained the case and has yet to rule.
In their complaint to the Supreme Court, Trump’s lawyers said they were “torn between the long-term uncertainty of the Presiding Judge and the imminent trial of the District Attorney” with no choice but to ask the Supreme Court to intervene.
Willis opened his investigation shortly before Trump was named Secretary of State of Georgia Brad Raffensperger in January 2021 and said the state elections director could help him “get” the votes needed to reverse his state election loss.
Special special judges, who he had no power to file charges, spent last May with melting in January after hearing from 75 witnesses and sending a report with Willis’ opinion. Although many of that report he sits down for now, team leader has said anonymously that the special court has recommended that more people be charged.
